Winners will be chosen based on a combination of criteria determined by the panel of qualified judges reviewing the top 10 entries with the most votes.

Grand Prize: $20,000 worth of rental goods, services and labor from a Montana production service vendor subcontracted by PartnersCreative.

Submission Prize: each eligible entrant will receive a DVD of the Montana Film Office, Studio 406 Webisode Series featuring producer Marty Katz.

Contest Requirements:

All entrants agree to the following requirements.

  1. Project Pitch Content: All entries must include why the project can't be filmed anywhere else but in Montana. At least 50 percent of the picture must take place in and be specific to Montana locations.

  2. Deadline: All submissions are due on or before November 30, 2011.

  3. Announcements: Winners will be announced and contacted on or about January 1, 2012. Judge's decisions are final.

  4. Entry Fee: There is no entry fee for the Montana Film Office, Studio 406 Project Pitch Contest.

  5. Releases and Copyright Material: If your submission contains any copyrighted material (music for example) the filmmaker will be responsible for securing the licensing rights. (To avoid the expense and difficulty of securing such rights we recommend using only original, noncopyright material or material licensed under the Creative Commons Attribution-ShareAlike license).

  6. Prizes: The winner shall receive $20,000 in goods, services and labor through a Montana Vendor or Vendors subcontracted by PartnersCreative. These goods and services will be issued while the project is shooting in Montana.

  7. Project Type: Entries may be any style or genre of film (e.g., documentary, narrative fiction, TV pilot, music video, etc.) with the exception of pornography. Material cannot be pornographic.

  8. Submission Format: Entries must be in digital format, as the submission process takes place at www.scout406.com. No physical entries will be accepted.

  9. Student or Group Submissions: Student submissions made with funding from a university or other institution are welcome, but if the school or institution holds the rights to the project, you will need its permission for entry. Group submissions (pitches submitted with more than one filmmaker) are likewise welcome, though each individual filmmaker must give permission for entry.

  10. Permissions for Montana Department of Commerce/Montana Office of Tourism/Montana Film Office Use: These entities reserve the right to display any entry submitted for the contest to be used for promotional purposes on the Montana Office of Tourism website (www.visitmt.com), all Montana Office of Tourism social media sites, Montana Film Office websites (www.montanafilm.com and www.scout406.com), Montana Film Office social media sites and at relevant events.

Contest Rules:

  1. Eligibility: Studio 406 Contest ("Contest") is offered and open only to legal residents of the United States and District of Columbia who are 18 years or older. Employees, officers and directors of the Montana Film Office/Montana Department of Commerce ("Sponsor"), and their affiliates, prize suppliers, advertising and promotion agency, and the immediate family members (defined as current spouse as well as siblings, children and parents and their respective spouses; regardless of where they live) or members of the same households (whether related or not) of such employees/officers/directors are not eligible. Void where prohibited by law. This contest is FREE to enter. A purchase or payment of any kind will not increase your chances of winning and will be returned to sender.

  2. Agreement to Official Rules: By participating in the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Sponsor (Montana Film Office) and/or Administrator (PartnersCreative), which are final and binding in all matters related to the Contest. Whether or not you receive a Prize is contingent upon fulfilling all requirements set forth in these Rules. The Contest is subject to all applicable federal, state and local laws. The Sponsor is responsible for ensuring the Contest complies with all laws in all jurisdictions where the Contest is offered.

  3. Contest Period: The Contest opens on the date and time specified in the Contest Summary, and ends on the date and time specified in the Contest Summary. All times specified are Mountain Time ("MT").

  4. How to Enter: Between August 22, 2011, at 12:01 a.m. Mountain Time ("MT") and 11:59 p.m. MT on November 30, 2011, go to www.scout406.com to register to win. On the page titled "Pitch Submission," complete and submit an online official entry form, with your name, address, business, title, email address, daytime telephone number and video submission. All online entries must be received by 11:59 p.m. MT on November 30, 2011. No other form of Internet/email entry will be accepted. Entries that do not include all the required information and adhere to the Rules will be considered void. Limit one entry of any kind per person or email address. Any person who attempts to participate with multiple email and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In case of dispute, online entry will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. No responsibility is assumed by Sponsor for lost, late, damaged, incomplete, stolen, misdirected, illegible entries or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions/failures; or for garbled, jumbled or corrupt transmissions; or for other technical error of any kind. Once submitted, entries become sole property of Sponsor and will not be returned. The Sponsor determines if an Entry meets the Contest Requirements and otherwise complies with the Rules.

  5. Terms of Submission: Limit one entry of any kind per person or email address. You may delete your Entry at any time. By participating in the Contest you permit public voting in connection with your Entry.

  6. Rights Granted by You: By entering this Contest, you agree that:

    1. the Sponsor and/or Administrator and its licensees, successors and assigns will have the right to use all or a part of your Entry, your name and address (city and state/province/territory), and the names, likenesses, photographs, voices and images of all persons appearing in the Entry anywhere in the world and in perpetuity, for future advertising, trade, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity, without compensation and without notice to you and without consideration, review or approval from you; and

    2. you agree that you will not now nor in the future be paid for your Entry or for granting the Sponsor and/or Administrator any of the rights set out in these Rules.

  7. Your Representations and Warranties: By entering the Contest, you represent and warrant that:

    1. your Entry, in its entirety, is an original work by you and you have not included third party content (such as writing, poetry, text, graphics, artwork, logos, photographs, likeness of any third party, musical recordings, clips of videos, television programs or motion pictures) in or in connection with your Entry without permission;

    2. your Entry, the use thereof by the Contest Sponsor and/or Administrator, of any of the rights granted by you under these Contest Rules, does not and will not infringe or violate any rights of any third party or entity, including, without limitation, patent, copyright, trademark, trade secret, defamation, privacy, publicity, false light, misappropriation, confidentiality, or any contractual or other rights;

    3. you have all the rights, licenses, permissions and consents necessary to submit the Entry and to grant all of the rights that you have granted to the Contest Sponsor and/or Administrator under these Contest Rules;

    4. all persons who were engaged by you to work on the Entry, who appear in the Entry in any manner, or have contributed to the Entry have:

      1. given you their written consent to submit the Entry without claims for payment of any kind; and

      2. provided written permission to include their name, likenesses, image or pictures in or with your Entry (or if a minor who is not your child, you must have the permission of his/her parent or legal guardian) and you may be asked by the Contest Sponsor and/or Administrator to provide such permission in writing to the Contest Sponsor and/or Administrator.

  8. Winner(s) Selection/Notification/Redemption: The winner(s) ("Winner(s)") of the Prize(s) will be selected, as specified in the Contest Summary from all eligible Entries received. If you are selected as a Winner, you will be notified of the selection of your Entry by the phone or email address provided by you on the Registration Form. If you do not respond to the phone or email notification of your selection as a Winner within three (3) days, an alternate Winner will be selected to receive the Prize. To claim the prize, entrant must have a legitimate project to shoot in Montana and will be required to provide a final script so that the Montana Film Office can conduct a location breakdown of said script, work with the winner on filming logistics and help secure any necessary permits. The winner will also have to secure any additional funds to shoot the winning project and produce evidence of this funding.

    To redeem the prize, the potential winner will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the "Affidavit") within ten (10) business days from the first day of notification. In the event:

    1. potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the entry form,

    2. of noncompliance with the above or within any of the aforesaid time periods,

    3. potential winner is found to be ineligible to enter the Contest or receive the prize,

    4. potential winner cannot or does not comply with the Official Rules,

    5. potential winner's prize notification or Affidavit is returned as undeliverable for whatever reason, or

    6. potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Contest and an alternate potential winner may be selected, at Sponsor's sole discretion, from among the other eligible entries received. The alternate selection will be conducted by the Montana Film Office/Montana Department of Commerce. By participating, entrant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Each Winner (or his/her parent/guardian if the Winner is a minor) is responsible for all taxes and fees associated with receipt of the Prize.

  9. Prizes: All eligible entrants will receive a DVD of the Montana Film Office, Studio 406 Webisode Series featuring producer Marty Katz. The Grand Prize winner shall receive $20,000 in rental goods, services and labor through a Montana Vendor or Vendors subcontracted by PartnersCreative. This package can be made up of goods, services and labor such as grip and lighting packages, office space and freelancers working in the industry. No substitution or transfer of prize is permitted, but Sponsor reserves the right, at its sole discretion, to substitute advertised prize with another prize of equal value should advertised prize become unavailable for any reason. Odds of winning a prize depend on the total number of eligible entries received.

  10. General Conditions: All taxes on prizes and all expenses not specified herein associated with claiming/use/acceptance prize is the sole responsibility of the winner. Grand Prize winner(s) must sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within 10 working days of the date specified in notification. By participating, entrant releases and agrees to hold harmless The Montana Department of Commerce and its respective parent, affiliates, prize suppliers, advertising and promotion agency and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons and/or property arising from acceptance, possession, use/misuse of any prize or participation in this Contest. By accepting the Prize, where legal, winner grants to Sponsor the right to use the winner's name, picture, voice, likeness and biographical information for advertising/promotional/trade purposes, and any and all rights to such use, without additional consideration. The Contest Sponsor and/or Administrator have the right to verify your eligibility and compliance with these Rules, and to disqualify you on the basis of its investigation. Your personal information will be processed in accordance with the Montana Film Office's Privacy Policy (www.montanafilm.com/privacy_policy.htm) as amended from time to time. You should direct any request to access, update, or correct your personal information to the Montana Film Office.

    You may not enter with multiple email and/or street addresses, nor may you use any other device or artifice to submit more than one (1) Entry or vote. If you use fraudulent Entry methods, or otherwise attempt to participate with multiple email and/or street addresses under multiple identities, or use any device or artifice to enter more than one (1) Entry, you will be disqualified. In the event of a dispute as to any Entry, the authorized account holder of the email address used to enter will be deemed to be the person who made the Entry. For the purposes of these Rules, the authorized "account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

    Nothing contained in these Rules shall be construed to:

    1. give any party the power to direct and control the day-to-day activities of the other;

    2. constitute the parties as partners, joint venturers, principal and agent, employer and employee, co-owners or entrants in a joint undertaking; or

    3. allow you to create or assume any obligation on behalf of the Sponsor or Administrator. By entering the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Contest Sponsor and/or Administrator and the members of the voting community, which are final and binding on all matters relating to this Contest. Contest Sponsor and/or Administrator reserve the right to cancel, modify or suspend the Contest at any time (subject to approval of any regulatory body having jurisdiction), if it is determined that the Contest cannot be run as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the Contest.

  11. Limitation of Liability: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. Any use of robotic, automatic, macro, programmed or like online entry methods will void all such entries/votes by such methods, and result in disqualification of any entrant/voter using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website.

    If, for any reason, the online component of the Contest is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the online component of this Contest, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the online component of the Contest and select the winners in a drawing from all eligible event and mail-in entries received and all eligible online entries received prior to and/or after (as appropriate) the action taken by Sponsor. In such event, notice will be posted at www.montanafilm.com and www.scout406.com.

  12. Winner's List: For names of winners, mail a self-addressed, stamped envelope to Montana Film Office, Attn: Studio406 Winners List, 301 S. Park Ave., Helena, MT 59620 by March 31, 2012.
